AEB & AGB AUSTRIA
General terms and conditions of use
1. scope of application
1.1 The following General Terms and Conditions of Hire and Use (GTCU) apply to all rental agreements between
ALPINA Parking GmbH (hereinafter referred to as “ALPINA”),
Billrothstraße 4, 1190 Vienna
Austria
Phone: +43 1 963 005 1
E-mail: [email protected],
and their tenants (hereinafter referred to as “tenants”).
1.2 The GTCP shall apply to all parking garages, parking garages, parking lots or other parking spaces (hereinafter referred to as “Parking Object(s)”) operated by ALPINA in its own name or as a contracted operator on behalf of the respective owner.
1.3 Special parking conditions for individual Parking Objects or tariffs shall take precedence over these GTCP. Individual agreements between ALPINA and the Lessee shall take precedence over both. Third-party terms and conditions of the Tenant shall only apply with the express consent of ALPINA.
2. subject matter of the contract
2.1 The subject matter of the contract is the provision of a parking space for the parking of a roadworthy and safe vehicle in the parking facility in return for payment of the agreed rent (parking fee). The parking space may be provided for one-off, short-term use or as part of a permanent or temporary rental agreement. The type, scope, duration and price of use are based on the tariff agreed upon conclusion of the contract or the tariff conditions applicable at the location.
2.2 A right to park the vehicle in a specific parking space only exists if agreed in writing with Alpina.
2.3 The Austrian Road Traffic Regulations (StVO) in the currently valid version apply accordingly at the operating location. The prescribed speed limit must be observed. The parking of vehicles without a police license plate is only permitted after prior written agreement with ALPINA.
2.4 Guarding, safekeeping or monitoring of the vehicle is not subject matter of the contract.
3. conclusion of contract
3.1 The contract is concluded at the latest when the vehicle enters the parking facility or when a rental contract is concluded in advance, at least in text form.
3.2 A camera-based license plate recognition system is used for entry and exit, if available at the location. The license plate number as well as the date, time, location of entry and exit and the resulting duration of use are stored. This data is used exclusively for the execution, billing and control of the rental agreement.
Further information on the processing of personal data, in particular on the storage period and the rights of data subjects, can be found in ALPINA’s privacy policy at https://alpina-parking.com/impressum-datenschutz-oesterreich/
Depending on the location, access to the parking facility may be via a parking ticket, license plate recognition, digital access media or other systems. The renter is obliged to use the respective prescribed access method or, in the event of technical faults, to use an alternative method specified by ALPINA.
4. content of the contract and terms of use
4.1 The Lessee is entitled to park passenger cars without trailers in the parking facility. Other vehicles, in particular motorcycles, may only be parked if this is expressly permitted by a corresponding sign. The prerequisite for parking authorization is always that the parked vehicle has liability insurance in accordance with the statutory provisions, an official license plate (KFG 1967) and a valid official inspection sticker (§ 57a inspection).
4.2 The parking of gas-powered vehicles, in particular those powered by LPG or natural gas/CNG, is generally prohibited in the parking facilities. An exception applies only to those parking facilities that are structurally and ventilation-wise suitable for this purpose and in which parking is expressly permitted by signs, provided that there are no legal provisions to the contrary.
4.3 The Lessor reserves the right to adjust this regulation at any time for reasons of safety, fire protection or due to changed legal requirements for individual or all parking facilities by means of appropriate signs.
4.4 One vehicle at a time may be parked within a marked parking space for the corresponding type of vehicle. Reverse parking in parking garages and multi-storey parking lots is not permitted and, if a parking space has been allocated, the vehicle must be parked in the assigned parking space.
4.5 Only a Tenant with this authorization may park in parking spaces that are designated by ALPINA for Tenants with special authorization (e.g. people with severe disabilities, women or users with an authorization from a rental agreement concluded at least in text form) and are marked or designated accordingly. To use a disabled parking space, the EU standard parking permit for people with disabilities or a corresponding national authorization is required. This must be placed in a clearly visible position behind the windshield immediately after parking the vehicle and left there for the entire duration of the parking period. Otherwise, the renter is obliged to provide suitable proof of his authorization upon request.
4.6 For long-term parkers without a specific, appropriately marked parking space, ALPINA strives to ensure an average parking space availability of 97%. In exceptional cases, however, particularly in the case of major events or exceptional utilization, it may happen that no parking space is temporarily available. The long-term tenant shall have no claims due to temporary unavailability.
4.7 The tenant must follow the instructions of any personnel deployed at the respective location and observe the terms of use, the traffic signs and information signs on site as well as the provisions of the Austrian Road Traffic Regulations (StVO), which apply accordingly in the parking facility. Within the parking facility, the vehicle may only be moved at walking speed.
4.8 The Lessee is obliged to report any obvious damage to ALPINA before leaving the parking facility and to give ALPINA the opportunity to inspect the vehicle. If this is exceptionally not possible or reasonable for the Renter, the notification must be made in text form (e.g. letter, e-mail, etc.) to ALPINA at the address stated in clause 1.1 no later than 14 days after the event of damage. In the case of non-obvious damage, the notification must be made in text form within 14 days of discovery of the damage (preclusion periods). Section 7.3 applies.
4.9 The parking fee is determined by the length of time a vehicle is parked between entering and exiting the parking facility (rental period) and the amount of the price shown at the time of entry, unless otherwise agreed in a rental agreement concluded at least in text form. Depending on the location, the rental time is recorded either by a license plate recognition system, by the time information on a parking ticket, by digital access systems or by other suitable means. Details on the processing of personal data when using the license plate recognition system are regulated in Section 10 of these GTCP.
4.10 In the case of payment by direct debit, the renter shall reimburse ALPINA for the costs actually incurred by ALPINA due to return debit notes or direct debits that cannot be carried out from the outset, if a SEPA direct debit issued by the renter fails due to a lack of funds in the account, for other reasons for which the renter is responsible or due to revocation of the SEPA direct debit mandate. This includes, in particular, return debit fees charged to ALPINA by its own bank (own fee) and, if applicable, by other banks (third-party fee). The amount of these specific fees incurred may vary depending on the banks involved and shall be verified by ALPINA at the request of the Tenant. The Tenant reserves the right to prove that ALPINA has incurred no or significantly less damage
4.11 Unless otherwise stipulated in a rental agreement concluded at least in text form, the parking fee must be paid before leaving the parking facility using one of the means of payment permitted at the respective location. In particular, this may include payment at automatic pay stations, via digital payment systems, via mobile apps, via QR code or via online platforms. If the license plate number is used as a means of access, this must be indicated when making the payment. Insofar as ALPINA expressly offers a pay-later option via SNAP&DRIVE at the location, the parking fee must generally be paid at a pay machine or via an approved means of payment before exiting. Only if immediate payment before exit is not possible, payment may be made within 72 hours after exit via the website accessible at the location by means of QR codes posted on the site. The renter shall compensate ALPINA for any damage caused by late payment within 72 hours after exit at the latest, unless the renter is not responsible for the late payment.
4.12 If the parking fee is to be paid before leaving the parking facility and if this is not possible for technical or other reasons, the renter must inform ALPINA immediately via the contact options signposted on site. In this case, ALPINA shall provide the Renter with an alternative payment option or set a payment deadline. The Renter remains obliged to pay the parking fee immediately. The vehicle may only be exited during the opening hours of the parking facility, which are either posted on site or otherwise announced.
5. charging electric vehicles
5.1 ALPINA may provide charging facilities for electric vehicles at selected parking spaces, but is not obliged to do so. The renter has no claim to the provision, function or availability of charging facilities. Even if charging infrastructure is available, ALPINA may restrict or discontinue its use at any time for technical, legal or economic reasons.
5.2 The charging facilities in the Parking Facility may only be used by electric vehicles that are technically suitable and approved for charging at the existing charging points. Use by plug-in hybrid vehicles is only permitted if they are technically compatible with the charging infrastructure.
5.3 The Tenant is obliged to use only the charging equipment installed in the parking facility as intended and in accordance with the manufacturer’s instructions. The use of extension cables, adapters or other accessories that are not expressly authorized is prohibited.
5.4 After completion of the charging process, the charging space must be vacated immediately. ALPINA is entitled to charge a reasonable blocking fee if the charging space remains occupied beyond the charging period.
5.5 The costs for the charging process are to be paid separately and are not included in the parking fee, unless otherwise expressly agreed or indicated at the location. The prices displayed at the charging point are decisive.
5.6 The Lessee is liable for all damage caused by improper use of the charging facilities. This applies in particular to damage caused by overloading, short circuits, fire or damage to the charging infrastructure.
5.7 The installation or use of own charging equipment (e.g. wallboxes, charging columns, sockets or other devices for charging electric vehicles) by the renter is not permitted without the prior written consent of ALPINA.
The installation or use of own charging equipment (e.g. wallboxes, charging columns, sockets or other devices for charging electric vehicles) by the renter is not permitted without the prior written consent of ALPINA.
5.8 The safety regulations posted on site also apply to the charging of electric vehicles. The Lessee is obliged to comply with these safety regulations.
6. use contrary to the contract
6.1 In particular, the uses listed in the following clauses (use contrary to the contract) are prohibited, namely
6.1.1 the parking and storage of objects and waste, in particular fuels and flammable objects as well as empty fuel containers,
6.1.2 the nuisance caused to the neighborhood by exhaust fumes and noise, in particular by the unnecessary running and testing of engines and by honking,
6.1.3 refueling the vehicle – this also applies to the charging of electric and/or plug-in hybrid vehicles outside the charging facilities provided and designated for this purpose by ALPINA,
6.1.4 the parking of vehicles with leaking tanks, oil, cooling water, air conditioning system tanks and carburetors as well as other damage that endangers the operation of the parking facility,
6.1.5 the stay in the parking facility, provided it is not exclusively in connection with the parking of a vehicle, in particular camping,
6.1.6 carrying out repair, maintenance or care work on vehicles,
6.1.7 contamination in the parking facility, in particular by cleaning the vehicle, draining cooling water, fuel or oil,
6.1.8 the unauthorized parking of vehicles, e.g. in the roadway area, in front of emergency exits or on hatched areas,
6.1.9 walking on the carriageways, including entrances and exits, unless there are no footpaths or hard shoulders,
6.1.10 the stay of persons who are not tenants of a parking space or authorized users of a parked vehicle or who do not have any other residence authorization from ALPINA (unauthorized persons),
6.1.11 smoking in the park property and the use of fire,
6.1.12 driving on the park property with vehicles or equipment such as bicycles, e-scooters, inline skates or similar means of transportation and parking them outside the designated parking spaces. Excluded from this are mobility aids (e.g. wheelchairs, walkers) and baby carriages,
6.1.13 the distribution of advertising material,
6.1.14 the use of motor vehicles over 3.5 tons, agricultural vehicles and military vehicles over 3.5 tons.
6.2 Use contrary to the contract also exists if the Tenant, who has not concluded a rental agreement at least in text form in advance, does not remove the vehicle from the parking property within a maximum of 15 minutes after completion of payment. If the Hirer exceeds this time, he/she shall owe an additional parking fee for the excess time in accordance with the applicable tariff.
7 Liability, exclusion of liability
7.1 The liability of ALPINA, its employees or vicarious agents is excluded for damages and claims for damages for whatever legal reason, unless these are based on intent or gross negligence. In the event of at least negligent breach of an essential contractual obligation, the fulfillment of which characterizes the contract and on which the renter may rely (“cardinal obligation”), liability shall be limited to the amount of damage foreseeable at the time of conclusion of the contract and typical for the contract. The above limitations of liability shall not apply to personal injury, i.e. to damages resulting from injury to life, body or health, in the event of liability under the Product Liability Act or in the event of the assumption of a guarantee.
7.2 ALPINA shall not be liable for damage caused solely by natural events, other renters or other third parties, in particular as a result of theft or damage to the vehicle.
7.3 If the renter violates his obligation to notify in accordance with clause 4.8, all claims for damages by the renter are excluded, unless the renter is not responsible for the violation. This exclusion of liability shall not apply if the Renter has suffered personal injury, in the event of a breach of a material contractual obligation or if ALPINA has caused the damage through gross negligence or willful misconduct.
8. termination of contract
8.1 The rental agreement ends when the vehicle leaves the parking facility, but no later than four weeks after conclusion of the contract (maximum parking period), unless otherwise agreed in a rental agreement concluded at least in text form.
8.2 If the vehicle remains parked in the parking facility after expiry of the maximum parking period or after termination of the rental agreement, the Lessee is obliged to remove it immediately. Any outstanding parking fees incurred up to the end of the contract shall remain due for payment.
8.3 For the period after termination of the rental contract, the Renter shall owe compensation for use in accordance with the applicable tariffs, insofar as the Renter is responsible for the failure to vacate.
8.4 If the Renter fails to comply with its obligation to vacate, ALPINA shall be entitled to have the vehicle removed at the Renter’s expense. Prior to removal, ALPINA shall request the Renter or – if the Renter is not known – the owner of the vehicle to remove the vehicle in writing, setting a reasonable deadline and threatening to evict the vehicle. This request shall not apply if ALPINA is unable to identify the owner or is unable to do so with reasonable effort, e.g. through the vehicle registration office. The Lessee shall bear the costs of evacuation, storage, utilization and, if applicable, disposal, unless it is not responsible for the failure to evacuate.
8.5 The Operator is entitled to remove the parked vehicle at the expense and risk of the Customer,
8.5.1 if the parking fee due exceeds the obvious value of the vehicle (low value); the low value of the vehicle must be determined by a competent person;
8.5.2 it endangers or impedes operation due to leakage of fuel, other liquids or vapors or due to other – especially safety-relevant – defects (e.g. no valid or expired inspection sticker);
8.5.3 it is not registered with the police or loses its police registration during the parking period;
8.5.4 it is parked in violation of traffic regulations or the contract, in an obstructive manner or in reserved spaces – in particular if towing would be justified under the Austrian Road Traffic Regulations;
8.5.5 a vehicle is parked entirely outside a marked parking space;
8.5.6 a vehicle obstructs more than one marked parking space;
8.5.7 the permitted charging time or parking time at a charging point for battery-powered electric or plug-in hybrid vehicles is exceeded.
8.6 Each party is entitled to terminate the rental agreement without notice for good cause. Good cause for ALPINA shall be deemed to exist in particular if the renter, despite a warning, again or continues to violate the General Terms and Conditions of Storage and Use or makes use contrary to the contract in accordance with clause 5, unless the renter is not responsible for this.
9. contractual penalty
9.1 If the renter loses its parking ticket or the access medium used for entry, the renter shall pay ALPINA a contractual penalty in the amount of one day’s parking fee, unless the renter is not responsible for the loss. Irrespective of a contractual penalty, the Tenant shall owe the parking fee for the rental period and compensation for use for the period after termination of the rental agreement.
9.2 For each case of culpable use in breach of contract within the meaning of Section 6 GTCP, ALPINA may demand payment of an appropriate contractual penalty of up to € 500 from the Tenant, depending on the individual case and fault.
9.3 Claims for damages shall remain unaffected by Sections 9.1 and 9.2. The contractual penalty shall be offset against any further claims for damages.
10. data protection and image recording
10.1 License plate recognition
If a license plate recognition system is used at the location, the license plate number as well as the date, time and place of entry and exit are recorded and processed when entering and exiting. This data is processed to execute and process the rental contract, to safeguard ALPINA’s legitimate interests, in particular to enforce contractual claims, to maintain operational processes and to provide parking services (Art. 6 para. 1 lit. b and f GDPR). The data will be deleted as soon as its purpose has been fulfilled, usually immediately after leaving the parking facility. If the processing is based on the tenant’s consent (Art. 6 para. 1 lit. a GDPR), this consent can be revoked at any time with effect for the future. The revocation does not affect the legality of the processing carried out until the revocation. A revocation for a parking process that has already begun is only possible after the parking time used so far has been billed.
10.2 Video surveillance
Certain areas of the parking facility are video-monitored and marked accordingly. Video surveillance is carried out on the basis of ALPINA’s legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR i.V.m. §§ 12, 13 DSG, in particular for the protection of life, health or freedom of persons, for the protection of domiciliary rights, for the protection of property as well as for the prevention and investigation of vandalism or criminal offenses. Further information on data protection, in particular on the rights of data subjects and storage periods, can be found in the privacy policy at https://www.alpina-parking.com/datenschutz.
11. final provisions
11.1 The law of the Republic of Austria shall apply. Legal norms that refer to another legal system shall not apply. In the case of contracts with consumers, the protection of mandatory provisions of the law of the country in which the consumer has his habitual residence shall remain unaffected. If translations of these GTCP are made into languages other than German, only the German version shall be binding.
11.2 The place of performance for ALPINA’s obligation to provide the parking space shall be the respective location of the parking object used. Unless otherwise agreed, the place of performance for the payment of the parking fee shall also be the location of the respective parking object.
11.3 The exclusive place of jurisdiction for disputes arising from or in connection with the contractual relationship existing between APLINA and the Tenant shall be Vienna, provided that the Tenant is an entrepreneur, merchant, a legal entity under public law or a special fund under public law. If the Tenant is a consumer, the statutory place of jurisdiction under Austrian law shall apply.
11.4 Should individual clauses of these GTCP be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions (severability clause).
11.5 ALPINA’s privacy policy and notes apply,
available at https://alpina-parking.com/impressum-datenschutz-oesterreich/
11.6 The status of the General Terms and Conditions of Rental and Use (GTCP) is November 2025.

The version of the GTC valid at the time of conclusion of the contract shall be authoritative. In the event of contradictions, the provisions of the respective individual contract shall take precedence over these GTC.

1.6 Customers of a group of persons defined by ALPINA (e.g. employees of a company at the location of a parking facility) can also conclude framework agreements with a fixed or variable term via the web store, which contain discounted conditions/tariffs for parking processes in certain parking facilities specified in the web store. Details of the contractual conditions of a framework agreement that go beyond these GTC can be found in the product description in the web store, in particular the applicable tariff (“pay-per-use“).
1.7 We do not accept deviating terms and conditions of the customer. This shall also apply if we do not expressly object to their inclusion.
§ 2 Conclusion of contract
2.1 The presentation and promotion of products in the online store do not constitute a binding offer to enter into a contract.
2.2 An order in the web store is only possible after prior registration and creation of a customer account. After successful registration, the customer will receive a confirmation e-mail.
2.3 By submitting an order via the web store by clicking on the “Book now” or “Buy now” button, the customer submits a legally binding offer to conclude a contract.
2.4 Upon conclusion of the contract, the customer accepts the General Parking Terms and Conditions and the General Terms and Conditions, available under “General Parking Terms and Conditions & General Terms and Conditions – ALPINA Parking & Mobility,” as well as the privacy policies, available under “Legal Notice & Privacy Policy” – ALPINA Parking & Mobility.
2.5 A contract is only concluded in the web store when ALPINA accepts the customer’s offer by sending a contract confirmation to the e-mail address provided by the customer. This e-mail contains the relevant contract details.
If the contract is concluded outside the web store, in particular after contacting ALPINA by telephone, ALPINA shall send the contract documents to the Customer. The contract shall only be concluded when the Customer signs the contract documents, returns them to ALPINA and ALPINA receives them.
2.6 If a contract is not concluded in accordance with clause 2.5, ALPINA shall not be bound by the customer’s offer. Payments already received shall be refunded immediately.
§ 3 Right of withdrawal for consumers

3.2 If the customer makes use of his right of withdrawal as a consumer in accordance with section 3.1, the customer shall bear the regular costs of the return shipment, if incurred.

For contracts concluded outside the web store, in particular after contacting us by telephone, the prices and conditions contained in the contract documents sent to the customer shall apply.
5.3 For the purchase of long-term parking or framework contracts, the monthly costs or costs per parking process (pay-per-use) are specified in the web store. These depend on the respective parking facility and the contract product selected by the customer as indicated in the product description in the web store.
5.4 The customer can pay the rental price at his discretion using a payment method shown in the web store.
5.5 In the case of long-term parking or framework contracts, payment and invoicing shall be made on a monthly basis.

5.7 The monthly usage fee for framework agreements and pay-per-use is due for payment on the last day of each month and is debited or collected at the end of the month from the customer’s specified account for the corresponding month.
5.8 If the agreed payment date has already passed when the contract is concluded, the usage fee shall be settled on the next payment date.

6.1 For certain Parking Facilities, ALPINA offers the option of paying parking fees before leaving the Parking Facility by scanning the QR code on the ticket or on the signage on site via a web app (“Mobile Pay”).
6.2 As provided in Section 1.2, Mobile Pay is conducted via electronic or online functions, such as through the website https://alpina-parking.com/ and the third-party technical platforms integrated therein (“Web App”).
6.3 If the customer uses the “Mobile Pay” feature, they can view and pay the parking fees incurred for the respective parking session via the web app by entering their license plate number before exiting the parking facility. ALPINA’s privacy policy, available under LEGAL NOTICE & PRIVACY – ALPINA Parking & Mobility, applies to the processing of personal data.
§ 7 Pay Later
7.1 For certain Parking Facilities, ALPINA offers the possibility to pay parking fees after completion of the parking process and exit from the Parking Facility (“Pay Later”).
7.2 In accordance with section 1.2, Mobile Pay is carried out via electronic or online functions, such as via the website https://alpina-parking.com/ and via the respective third-party technical platforms integrated there (“web app”).
7.3 If the customer uses the Pay-Later feature, they can enter their license plate number to view the vehicle’s parking transactions via the Pay-Later platform within a period of up to 72 hours after the respective parking session ends and pay the accrued parking fees. The license plate number is used for this purpose to assign the parking transactions to the respective vehicle and to determine the parking fees incurred. ALPINA’s privacy policy applies to the processing of personal data; it is available under LEGAL NOTICE & PRIVACY – ALPINA Parking & Mobility.
§ 8. Governing Law and Jurisdiction
8.1 The laws of the Federal Republic of Germany shall apply. Legal provisions that refer to another legal system shall not apply.
